Holiday Rental Agreement for The Judges Library

This Holiday Rental Agreement is a contract between you (Guest), and us (Owners). It will come into existence when we receive payment and accept your booking by issuing a confirmation of booking for the holiday dates you have chosen. The contract binds you and all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms and conditions of booking. Nothing in this Holiday Rental Agreement affects your usual statutory rights.

The Judges Library is privately owned and is our holiday home. We hope you will make yourselves comfortable here, and treat the property with the respect that a nice home deserves.

Parties (Guests and Owner) hereby agree as follows:

1.Property: The holiday rental property known as The Judges Library is located at: Llysyronnen, Quay Street, Carmarthen, Wales SA31 3JT

2.Payment Schedule: 50% due at time of booking. Remaining balance due 15 days before arrival. In the event that: any balance required from you is not paid in accordance with the above; or you do not arrive at the property within 24 hours of your arrival time without notifying us, then you will be charged the total price of the reservation, and we shall be entitled to treat your Booking as being cancelled, and the Cancellation Policy shall apply.

3.Cancellation Policy: All paid prepayments are non-refundable. We strongly advise that you take out comprehensive travel insurance. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation. Our liability for cancellation will be limited to payments made to us. Your booking will not be cancelled by us, except in exceptional circumstances beyond our control; in which case you will be notified as soon as possible and we will promptly refund all payments made to us for your holiday. However, we will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities or insurance).

4.Damage Deposit: No damage deposit is due.

5.Accommodation: Bedroom, Sitting room, Dining Room, Kitchen, Bathroom, Service Corridor, Patio.

6.Furnishings: The property is fully furnished and includes:

Electric cooker with 4 ring Hob, Grill, Oven, Refrigerator, Microwave, Dishwasher, Kettle and Toaster. Fully equipped with pots and pans, cutlery and crockery.

Breakfast Bar and 2 stools.

Dining Table and 4 chairs

Corner sofa and armchair, 3 coffee tables, 3 table lamps, writing Bureau

King-size Bed with 4 pillows, duvet and sheet. All cotton.

Wardrobe and 2 bed side tables with 2 lamps.

Several Art pictures on walls.

4K Smart TV with Netflix and TV licensed for BBC, ITV.

Gas Combi Boiler providing Instant Hot water and instant Central heating.

Rainfall Shower in spacious glass enclosure. Wash basin, Toilet, Shaver socket.

2 Large towels and 2 smaller towels.

2 vacuum cleaners. Reading books on shelves.

Hairdryer, iron, ironing board.

All inventory including towels must remain in the property.

Bring your own Beach Towels or contact us if you would like to hire some.

7.Rental Party: The rental party shall consist of Guest and no more than one other person.

8.Age restriction: Bookings are not accepted from persons less than 18 years of age.

9.Maximum Occupancy: The property is one bedroom with King Size bed. Occupancy limited to 2 persons, both no less than 18 years of age. Only those listed on the Booking form may occupy the property. The Dining Table will seat 4 persons. We do not allow parties, so no more than 4 people will be allowed in the property at any time.

10.Term of the Lease: Tenancies normally commence at 4pm (unless otherwise agreed), and guests are required to vacate the property by 10am on the day of departure (unless later checkout is agreed). This gives us time to thoroughly clean and prepared for our next guests.

11.Minimum Stay: This property is not available for 1 night only. Usually 2 night minimum stay.

12.Check In – Entry: The Judges Library has a Lock box Key Safe. You will need a Code to get the Key. This is usually sent separately to any other communication containing address. It is your responsibility to ensure that you have the Key Code before arrival. We endeavour to answer communication within 2 hours, but this will not always be the case especially not late at night.

13.Parking: No parking at the property. Limited on street parking nearby. Pay Car Parks Nearby.

14.Access: Owner will not enter the property without good reason, or without warning. Guest shall allow Owner or their representative access to the property for purposes of repair, inspection or emergency. Owner/ representative reserve the right to enter the Service Corridor and Patio area by giving 30 minutes notice. The Service Corridor is a fire escape route and should be kept clear of obstruction; it is also where the gas, electricity, water and drainage enter the property. Service Corridor access will not impact Guests privacy as it is separate from the internal rooms. We shall exercise the right of access to the internal rooms in a reasonable manner by giving at least 3 hour notice. *No notice is necessary in case of emergency.

15.Rental Rules: Guest agrees to abide by the following Rental Rules at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times. We reserve the right to terminate the booking without notice and without refund in case of a breach of this condition: No Pets, No Parties, No Smoking. Smoking restriction is internal only - We have provided an ashtray on the patio table and a sand pot for cigarette disposal.

16.Neighbours: Guest agrees not to do anything that may be reasonably considered to cause nuisance or annoyance to any other occupier of adjoining or neighbouring properties.

17.Property care: Guest agrees to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition, and not to cause any damage to the walls, doors, windows or any other part of the Property. In the event that you notice damage in your accommodation please let us know immediately so that we can take the appropriate action. If damage occurs during your stay, we hope that you will be reasonable; advise us before you leave and discuss responsibility and the funding of repair or replacement.

18.Personal Property. The property does not have a safe. Guest agrees to take all necessary steps to safeguard their personal property whilst at the Property.

19.Security: All doors must be locked and windows closed when you leave the property unoccupied.

20.Key Return: When you check out place the keys back into the Lock Box, and make sure the box is securely closed. Please note that in the event that any keys issued are not returned at the end of your stay, then the cost of replacement locks will be charged to you.

21.Wifi: Wifi and Smart TV, including Netflix, is available (at no extra cost) subject to technical availability.

22.Functionality: The Owner shall not be liable for any loss of electrical or digital signal or TV operation, nor for any temporary defect or malfunction of other equipment/appliances at the property.

23.Complaints: Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible. It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve problems properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence at the Property will usually enable any shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence at the Property. If any complaint cannot be resolved during your holiday, you must write to us or email us with full details within 28 days of the end of your Booking.

24.Limit of Liability: Our maximum liability for losses you suffer as a result of us acting in breach of the Booking Contract is strictly limited to the amounts received by us in relation to your Booking. Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you. For the avoidance of doubt, we shall not be liable to you or responsible for: any issue between you and us regarding the Booking; any failure in relation to any payments due to the failure of a payment solution provided by a third party; and the rejection of any payment of yours by a third party payment solution provider. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability.

25.Law and Jurisdiction: This Rental Agreement (including any non-contractual obligations arising under or in relation to it) between you and us is governed by the law of England and Wales, and we both agree that any dispute, matter or other issue which arises between us will be exclusively dealt with by the Courts of England and Wales.

26.Amendments: We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
